Tornado or Scud?

This was in May of 2010 along Backbone Mountain in Oklahoma under a tornado warning for strong low-level rotation. Above and left of the car lights is that scud or a tornado down on the mountain? Just seeking opinions...

For my image think it was a scud cloud because it was pretty close to Fort Smith Arkansas but no tornado was reported.
